because, like someone posted previously, as soon as that grumpy old cow phones the council ranger, its reported as a "nyusance" as she told me that she only phones the council as its her duty to get me off the field...

once that phone call comes in, its a reasonable excuse to kick me off the field for causing a "nuisance" despite obviously me causing no nuisance to this woman who is about 250m upwind of where i fly and her flat balcony doors faces away from where i fly (more or less)so she cant even see me unless she comes out of her flat and looks for me...which she does...

Then go into hiding at Frinton-on-Sea...no bans there!

In fact the retired old biddies come out to watch & can name all the tricks

exactly...the majority of people who live there actually watch, one guy came out and had a chat saying he had a go at it (kitesurfing) in 2001 in holiday somewhere (cant remember where :o) and that it was great fun if a little dangerous back then

i have always got people watching, asking for info on the stuff, where to buy gear, how much my landboard costs (little tricky to explain its not really a priced deck since its the only one of its kind :D ;))

anyway, i will be checking this council mans claims of where kites have landed, crashed into, and all that...cos if hes wrong, ill be making a point of opinionated council workers in the local paper, that should get some action ;)

otherwise, the press will be contacted anyway, i want some support and for people to realise how ridiculous their banning of the sport is...

I get peeps all the time watching me too down on my local field. They watch in amazment as i sore throught the air like a swallow riding on the wind until i go arse over tit then they point and laugh....:D I even put my kite bag and board bag in one of the gardens that back onto the field often get people asking questions about the board and kite.Just takes one coffin dodger to spoil your fun mate. Think you should kite right outside her flat and when she steps outside knock her off the balcony with said kite. Sorted.:D

Heres johnny - I read the e-mail you posted from the councillor, in reference to when he talks about kites being flown badly (crashed into houses etc) why don't you request that he provides evidence (i.e. photos, written statements etc) of all the incidents he mention. Alternatively, you could get him to come watch you fly and show to him exactly what it is your doing and show that you are not causing any such danger to 'members of the public' or any damage to land or property, surely, if that goes well how can he keep the ban in force!

Good luck, and don't give up on it!

I have a plan.

Write back in a few weeks or so and tell him that in light of this ban, you've turned to drugs, alcohol and abusing the elderly population because there's nowhere for you to kite around here. You've been thrown out of home because you've become depressed, violent and unpredictable, nobody particularly likes being around you.

By 'write back', I mean scribble it down on a dirty, stained bit of cardboard as if you were actually homeless or something :)

There was me thinking he already did all that. Being a youth and all......... He could alway give the council the great line all actors use...".Do you know who i am." Being he looks like a certain actor off Corrie...Sorry Jonny but you do...:D

right then its time to complain about kites on your fly site about every 35 minutes every windy day until they get fedup answering the phone to moany old tits then crack on and fly till your hearts content

I think Festa's got the right idea. Fly there as often as you like, what have you got to lose? Assuming the council don't control any other flying sites that people care about I can't see how you could make things worse.

Didn't you mention before that after 6 there is not even anybody at the council to answer the phone? Fly there after 6 every day until the old people get sick of calling. Fly there static (which is within the rules) and watch the old people call and call, only to be told that it is OK for you to fly, then they will get confused. Fly there before 6 with your borad, and each time the park ranger shows up, just apolgize and go home. Then come back and fly static again the next day. Repeat. If he brings a cop, (assuming that he can find one willing to put down the donut and do some work) apoligize and go home. Then show up to fly the next day. If anybody who is not a council official or a cop comes to you to complain, just ignore them. You should be able to play this out for many times until they actually can get a cop to ticket you. I'd bet that the cops will tell the council to take a leap when they call.

If you get a ticket, pay it, then go fly there again. How much can the ticket be, 40 quid or something? I pay almost that in gas each time I drive to the coast. Take plesure in the fact that the old people will be purple with rage as the they continually call the council, and the council will eventually start ignoring them. Turn this into a giant time wasting exercise for everyone but you.

By the way, don't treat this as legal advice!

my local byelaw.....

21. No person shall skate, slide or ride on rollers, skateboards or

other self-propelled vehicles in such a manner as to cause danger

or give reasonable grounds for annoyance to other persons.

42. No person shall fly any kite in such a manner as to cause danger

or give reasonable grounds for annoyance to any other person.

not much to go on but i think the police wouldn't care unless you were endangering others near you

i've had those exact byelaws quoted at me when told to piss off out of a london park and stop flying there.

i tried getting a local councillor involved, but it didnt help much

Get the local MP involved.... IF they cant sort it, then get them to find some where for you ^_^

They're there to help us so get on their case !!!

I had an issue a while ago with the council, I gave them 14 days to sort it (diplomatic letter and email) or I would go to local radio and papers to air my concerns..... 24hrs later I had the help!!

Be tactful, and give them time to reply.... never be sarcastic. Also IF you feel like you not going to get the answer you'd expect, ask them what are the alternatives available to you. (my tuppence worth)

All valid points, best try writing to the paper (not the local under the thumb of the council one) maybe the sun, they LOVE stories of councils making a meal of stuff and lets face it, you're not drinking cider, taking crack or putting cats in blenders, show them that councils increase broken Britain by banning and harassing genuine, good young people. I'd say check your facts, ask for definitions (if you can make them ban kids bikes that would be funny).

OH and aren't we a proper sport now? They HAVE to provide space for proper sports!

I find people are a lot easer to persuade the fewer insults you use. As the advice has already stated, use tact, watch who you are speaking to - also if the council have quoted this particular forum before (as it's public access), do yourselves a favour, and avoid insulting them.

Yes the council can appear to be real nags, along with the locals. If they don't act, they lose their job. If they do act against you, they are deemed idiots.

Ask whoever you're insured if they can help - maybe they can throw up some ideas. When the council started getting a bit nosey round here a couple of us did our instructor courses & a few others started a kite club & invited the council down to have a look at what we were doing. They never bothered & just left us to it. Find a girl kiter - they don't perceive us as hoody youths & assume we're all sensible! Do you have a local shop that could help you? Maybe if you could work with them to give something back they'd see a more positive outcome - they like shops, they have a place they can go if something goes wrong. Marie here used to have a fortnightly drop in on the beach where any newbys with their argos kites could get help - they saw that as a tourist opportunity for free, they liked that! More money for the councils - would you pay for it? Maybe suggest a club with rules - they like rules, tenner a year, you have to be insured & with a helmet & a member of the club to fly? Would a 1st aid course help them ?Negotiate a time when people use the green less? BRS used to be you could kite after 8pm during the summer.

Tiz crap tho!

"42. No person shall fly any kite in such a manner as to cause danger

Aren't we missing the point here, it does not say you can't fly - just states "in such a manner as to cause danger etc".

Don't they have to prove you are causing a 'danger' or 'reasonable annoyance' (what the hell is a reasonable annoyance?) before they can kick you off or ban you completely?

So if you are flying responsibly (e.g. not flying your kite into flats and people) the byelaw they have added is useless as it does not ban the use of kites just kites that are causing a danger etc (which they would have to prove).

Just a thought

saying aim allowed to do these things without causing annoyance is fine, but as soon as the old woman phoens the council its registered as a nuisance event (or something) and i have to legally move on according to the council man..."the byelaw says so..."

weve emailed rhe council several times, all we get is stuck up people refusing to embrace a fast growing popular sport, and they just quote byelaws and make us sound like the bad guys..

also, they tried to prosecute people for kitesurfing on a supposed banned beach, where there were signs stating no kitesurfs or windsurfs allowed (good terminology)....obvioulsy we are allowed there, so we all went out on the water, they tried to prosecute for breaking the byelaws, when THERE WAS NO BYELAW IN PLACE

they spent £60,000 on signage for the seafront saying no to this and that, then had to scratch off or paint over the kitesurf bit as they had illegally banned people from flying kites on the beach when there was no such byelaw passed (it was still months from ebing passed, and is now even further from being passed)

also, theyre regenerating our seafront.....or thats what they like to call it, basically means rip the whole fucking thing up in the height of summer tourist season, and replace the natural stone wals and beautiful flower beds with concrete slabs (vandal heaven) concrete steps height edgin (or something, again graffiti target) and replace the perfectly adequate seafront shelters with ones that will provide no protection from wind and rain in any direction, which the others did perfectly...

basically the councils fucking stupid, and there seems to be almost no chance of getting kiting back on Galley Hill...

fuckers....theyve lost my support for anything they do in the future...fuck em...

apologies for my harsh tone....they annoy me :)

Unfortunately dude your age is going to go against you. I'd recommend finding a kite shop or see if BKSA/PKSF can help. Do you compete? Some councils offer grants to help upcoming sports men & women travel to comps etc, it's not much but the point is would be amusing if you were eligible! :)
